Terms & Conditions

1. Definitions

In these Terms and Conditions: "Archway" refers to the property advisory firm operating from 170 Sathorn Soi 12, Silom, Bang Rak, Bangkok 10500, Thailand. "Client" refers to any individual or organisation that engages Archway for any of its services. "Services" refers to the three service lines offered by Archway: Sathorn Business Rentals, Precision Home Placement, and Executive Tenancy Retainer. "Agreement" refers to the service engagement terms agreed between Archway and the Client.

2. Acceptance of Terms

By submitting an enquiry through this website, commencing a service engagement with Archway, or accepting a written service proposal, the Client agrees to be bound by these Terms and Conditions. These terms apply to all service engagements unless superseded by a separate written agreement signed by both parties.

The minimum age for engaging Archway's services is 18 years. By engaging our services, the Client confirms that they have the legal capacity to enter into this agreement.

3. Service Description

Archway provides property rental advisory services to tenants in Bangkok, Thailand. Services are limited to Sathorn Business Rentals (furnished apartments for stays of two weeks to three months), Precision Home Placement (annual lease search and placement), and Executive Tenancy Retainer (ongoing tenancy management support). Services are focused on Bangkok's central districts. Archway does not provide property services outside these defined offerings without a separate written agreement.

4. Client Responsibilities

The Client agrees to provide accurate information when completing any requirements brief or enquiry form. The Client understands that the quality of Archway's shortlist and recommendations depends on the accuracy and completeness of the brief provided. The Client agrees to notify Archway promptly if their requirements, budget, or timeline change during an engagement.

The Client agrees not to use Archway's shortlists, comparative analyses, or briefing notes for any purpose other than their own personal or corporate property search. Archway's research materials may not be shared with third parties or used for commercial purposes without written consent.

5. Payment Terms

Fees for Archway's services are quoted in Thai Baht (฿) and are as follows unless varied by written agreement: Precision Home Placement — ฿35,000 (one-time fee, payable upon commencement of the shortlisting process); Executive Tenancy Retainer — ฿6,500 per month (payable monthly in advance); Sathorn Business Rentals — ฿48,000 per month or as quoted based on specific property and duration.

Fees are payable by bank transfer to Archway's designated account. Payment details are provided upon engagement confirmation. Invoices are due within 7 days of issue unless otherwise agreed. Archway reserves the right to suspend services where invoices remain unpaid beyond 14 days without agreed extension.

Refunds: The Precision Home Placement fee is non-refundable once the shortlisting process has commenced. Retainer fees are non-refundable for the current billing month; cancellation takes effect at the end of the paid period with 30 days' written notice required.

6. Intellectual Property

All shortlists, comparative analyses, briefing notes, and written reports produced by Archway remain the intellectual property of Archway. A limited, non-exclusive, non-transferable licence is granted to the Client to use these materials for their own property search only. Clients may not reproduce, circulate, or commercially exploit these materials without Archway's prior written consent.

7. Disclaimers

Archway acts as a tenant advisor and does not hold estate agent licences or act as a party to any lease agreement. All lease agreements are entered into directly between the Client and the relevant landlord. Archway's review of lease terms is advisory only and does not constitute legal advice. Clients are encouraged to seek independent legal advice on lease agreements where appropriate.

Property market conditions in Bangkok are subject to change. Archway cannot confirm that pricing observations in comparative analyses will remain accurate beyond the date of issue. Archway makes no representation as to guaranteed lease availability or property conditions after a lease has been signed.

8. Limitation of Liability

Archway's total liability to the Client in connection with any service engagement is limited to the fees paid by the Client for that specific engagement. Archway is not liable for any indirect, consequential, or incidental losses arising from the use of its services, including any losses arising from lease terms entered into by the Client independently.

Archway is not liable for the conduct of landlords, building management companies, or third parties, even where Archway has facilitated the connection with such parties as part of a service engagement.

9. Termination

Either party may terminate an ongoing service engagement with 30 days' written notice. For the Executive Tenancy Retainer, notice must be provided in writing to legal@archweess. Termination does not affect any rights or obligations that have accrued prior to the termination date.

Archway reserves the right to terminate a service engagement immediately where the Client has provided materially false information or has breached these Terms in a material respect.

10. Dispute Resolution & Governing Law

These Terms and all service engagements are governed by the laws of the Kingdom of Thailand. In the event of a dispute, the parties agree to first attempt resolution through direct discussion within 20 business days of the dispute arising. If resolution cannot be reached, the dispute shall be subject to the jurisdiction of the courts of Bangkok, Thailand.

11. Changes to These Terms

Archway may update these Terms from time to time. Updated terms will be published on this page with a revised effective date. For ongoing service engagements, clients will be notified of material changes by email with at least 14 days' notice. Continued use of Archway's services after the effective date of revised terms constitutes acceptance of those terms.
